FAIRMONT, W.Va. — A Marion County judge has ruled the sale of John Manchin Senior Health Care Center is legal and the sale is set to close Friday.
The deal $60 million transaction with Marx Development in August includes the sale of the John Manchin Center, plus the Hopemont Hospital in Terra Alta, Jackie Withrow Hospital in Raleigh county and Lakin Hospital in Mason County.
Fairmont attorney and state senator Joey Garcia filed a lawsuit on behalf of a resident who argued the sale could jeopardize the quality of care. Marx Development has also agreed to build new facilities but has not been able to confirm where they would be located.
The state argued the transition was already in process and any ruling against the sale could disrupt the care of thousands of patients.
After two and a half hours, Judge Matthew Delligatti ruled to vacate the Temporary Restraining Order.
