WHEELING, W.Va. — The former Buckhannon city councilman facing federal child pornography charges is scheduled for a plea hearing on Dec. 5.
David McCauley, 66, has been charged with two counts of production of child pornography and one count of felony possession of child pornography.
In exchange for a guilty plea to felony possession of child pornography McCauley would agree to serve not more than 10 years in prison and pay a fine of $250,000. The two counts of production of child pornography would be dropped.
If the deal is accepted by the court, McCauley would have to register as a sex offender and would face between five years to life under supervised release.
McCauley, who once served as mayor of Buckhannon, was charged and incarcerated in October and has been in federal custody since. Next week’s hearing is set for 10 a.m. in Wheeling federal court.
McCauley was scheduled to go to trial for the charges on Dec. 9.
